Defense expected for Indiana boy, 12, in murder trial

MARTINSVILLE, Ind. (AP) -- The defense is expected to start presenting its case in the murder trial of a 12-year-old boy charged with shooting his brother while they were alone at their central Indiana home.

Testimony is scheduled to continue Wednesday in a Morgan County court in the June death of 6-year-old Andrew Frye.

In a videotaped police interview played in court Tuesday, the older boy said he didn't know a rifle was loaded when he pulled the trigger and shot his brother in the head.

The boy was 11 at the time and said in two other videotapes that his brother shot himself at their home near Martinsville. But an autopsy found that Andrew's arms were too short to have shot himself.

The prosecutor says the older boy's actions were at least reckless.
