LOUISVILLE, Ky. (WDRB) -- The Jefferson County Public Schools student assignment plan will go to the state Supreme Court.

The school board voted unanimously Monday night to appeal last month's state appeals court decision that said students had the right to attend neighborhood schools.

The decision was harshly critical of the student assignment plan.

The attorney who challenged the plan, Ted Gordon, said the school board has "once again chosen the court room over the classroom."

The supreme court may not hear the case until sometime next year.
