LOUISVILLE, KY. (WDRB) -- The constable who has been criticized after he was involved in a shooting outside a Wal-Mart on November 2nd has been the focus of a review by the Commonwealth's Attorney's office for the past two weeks.

Commonwealth's Attorney David Stengel began that review the day after the incident involving Constable David Whitlock, according to a news release.  That release also says the Commonwealth's Attorney's office has received information from the LMPD Public Integrity Unit, but that it is waiting for a full report before deciding whether charges should be filed.

Whitlock has garnered criticism after he was involved in that shooting outside a Wal-mart in south Louisville. Whitlock, who was at the store shopping while off-duty, says he was asked by store security to help with a suspected shoplifter.

Authorities say he approached Tammie Ortiz in the parking lot. That's when he claims she ran over his foot and fired his gun – striking her in the arm and face.
