New Albany police officer appeals suspension

LOUISVILLE, KY. (WDRB) -- Next week, the Indiana Court of Appeals will hear arguments in the case between Jack Messer and the New Albany Police Department.

In 2010, Messer said, "the worst thing they could have ever done was give African-Americans civil rights."

Messer was suspended for conduct unbecoming of an officer.  He apologized, and denied he was racist.

On appeal, Messer argues that his statement was protected by the First Amendment, so he should not be disciplined for speaking as a citizen in a private setting.
