U.S. Supreme Court won't hear lawsuit by private school athletes

Posted: Updated:

LOUISVILLE, Ky. (WDRB) -- The U.S. Supreme Court has refused to hear a lawsuit that pits Kentucky private school athletes against the state's athletic association.

Louisville attorney Teddy Gordon filed the suit in 2009 on behalf of Presentation Academy student Erin Evans.

She was on the school's volleyball team.

But KHSAA rules prevent a student from playing sports if more than 25% of their tuition is paid for by academic scholarships.

The rule is meant to prevent schools from recruiting players.
