Man charged with murdering Sullivan student found competent

LOUISVILLE, Ky. (WDRB) -- The man charged with murdering a Sullivan University student has been ruled competent to stand trial.

The public defender's office hired a doctor to do a competency evaluation. The doctor spent 15 hours with Gregory O'Bryan and says he does have a mental illness, but is competent to stand trial. But, he did not conduct an IQ test on him.

The prosecution had several issues with the report, saying it wasn't detailed enough. But the judge ruled O'Bryan can go to trial in November.

Dr.Phillip Johnson, who works for the Luther Luckett Correctional Complex says, "In this state, for a person to be competent to stand trial, they have to understand, appreciate the charges against them, the possible consequences associated with those charges."

Detectives say Andrew Compton met O'Bryan online and that the two were having sex when Compton died.

Police say O'Bryan told them he put the body in a dumpster, but the body was never found.  Back in February, prosecutors revealed that three pieces of flesh were found at the Indiana landfill where police think the body was dumped.  The pieces of flesh are being tested to see if the DNA matches Compton. Four unidentified fluids collected from O'Bryan's apartment are also being tested.

Next week, there will be a hearing about evidence in the case. If convicted, O'Bryan could get the death penalty.
