LOUISVILLE, Ky. (WDRB) -- The Jefferson County Constable charged with shooting a woman in a Walmart parking lot is still deciding if he wants to take a plea deal.
Prosecutors have offered David Whitlock a plea deal where he would plead guilty to assault under extreme emotional distress and wanton endangerment.
Under the plea deal, he would take part in a court-ordered diversion program.
After he successfully completes that program, his charges would be dropped.
But he would also have to give up his right to work in law enforcement.
Whitlock says he wants more time to make a decision.
If convicted, Whitlock could face between five and fifteen years in prison.
But under the plea deal, there would be no jail time.
On November 2nd, Whitlock, dressed in plain clothes, says he shot Tammie Ortiz believing she was a shoplifter at a local Walmart. Investigators say he fired his gun after she ran over his foot with her car. Bullets hit her arm and face, but she survived.
He'll have to decide by September 11th at his final pre-trial conference or he'll go to trial in January.
