Family of Frayser Elementary student found hanging files lawsuit

LOUISVILLE, KY. (WDRB) -- The family of a student found hanging from a bathroom stall door at a Louisville elementary school has filed a lawsuit against two fifth graders.

The Frayser Elementary School second grader was hospitalized for several days after the incident in March 2011.  The lawsuit claims the boys hit the child, twisted his neck, and left him unconscious and to die by hanging on the back of a hook.

The child was rescued safely from his predicament and has since recovered.

Detectives investigated, and determined the students were not involved in the incident.

The lawsuit also names the principal and a teacher, saying they did not do enough to protect the child.
