NEW ALBANY, Ind. (WDRB) -- Police have arrested a New Albany man for allegedly leaving his 2-year-old child alone in an unlocked apartment while he was out driving.
According to a probable cause affidavit, 30-year-old Jose-Luis J. Garcia was involved in a car accident on Wednesday at the corner of 13th St. and Spring St. in New Albany. Police say Garcia was driving a 2000 Honda van involved in the accident.
"When I asked him for his drivers license, he admitted to me that he did not have a license," the arresting officer wrote in the probable cause affidavit. "A computer check revealed he had never been licensed."
Police say Garcia was "very upset" about the accident and kept talking about his 2-year-old child. Garcia allegedly told the officer that his child was at home sleeping.
"I asked him who was watching the child, and he said no one," he arresting officer wrote. "He admitted that he did not want to wake the child."
Garcia allegedly told the officer that the mother of the child was in Floyd Memorial Hospital giving birth.
Police say the child was eventually located inside Garcia's unlocked apartment, asleep and alone.
Garcia was arrested and charged with neglect of a dependent and operating a motor vehicle without ever receiving a license, according to court documents.
