Suspected shoplifter files lawsuit against constable, Wal-Mart

LOUISVILLE, KY. (WDRB) -- The suspected shoplifter who was shot at a Wal-Mart by a Jefferson County constable has filed a lawsuit against him and the store.  Tammie Ortiz is suing David Whitlock and Wal-Mart.

Whitlock was charged after the shooting at the store on Raggard Lane in November 2011.  Last month Whitlock reached a plea deal in the case, avoiding jail time if he completes a diversion program.

Ortiz claims Whitlock was negligent in his actions and his use of force was excessive.  She also blames Wal-Mart because the store often used Whitlock for assistance with store security.
