LOUISVILLE, Ky. (WDRB) -- A husband and wife were arrested Thursday evening after police say they were found passed out in a vehicle while two children were left unattended in the back.
According to an arrest report, a witness had called police after following an intoxicated driver until the car stopped at the Dongar Food Mart at the corner of Lexington Road and Payne Street, shortly after 7 p.m. The caller remained on the scene until police arrived.
When officers got there, they allegedly found 40-year-old Kerry Poynter and 23-year-old Samantha Poynter unconscious in a red 1995 Cutlass Oldsmobile.
Police say Kerry Poynter was found passed out in the driver's seat with his foot on the brake, the engine running and the transmission in drive. Samantha Poynter was allegedly passed out in the passenger seat, and two children -- ages 3 and 4 -- were in the back seat.
"The children were unable to awaken [the] parents and were visibly upset and unable to provide for their own care," police say.
Both children were standing up in the back seat, according to the arrest reports, and neither were secured in seat belts or in their child safety seats.
Police say an officer had to reach into the vehicle, put the transmission in park and shake Kerry Poynter several times to wake him up. He was allegedly "unable to follow simple instructions," and had, "red, bloodshot eyes, slow, slurred speech, unsteady gait, droopy eyelids, constricted pupils, labored movements" and was, "extremely drowsy."
Police say he admitted to taking Xanax and Oxycodone.
According to the arrest report, Samantha Poynter was found "drooling on herself," kept falling asleep while standing and talking with police officers, and was so intoxicated that officers "feared for her safety and the safety of the children involved."
Police say they found a bottle of prescription drugs in her purse that didn't belong to her.
According to the arrest report, Kerry Poynter did not have proof of insurance on the vehicle, and the registration plate had been canceled. The vehicle was impounded and the children were placed in the custody of their grandmother.
Both Samantha and Kerry Poynter were charged with endangering the welfare of a minor. Kerry Poynter is charged with operating a motor vehicle under the influence of alcohol or drugs, failure to maintain required insurance and failure to have valid registration plates. Samantha Poynter is charged with public intoxication and possession of a controlled substance.
