LOUISVILLE, KY. (WDRB) -- The first lawsuit has been filed in the October 29th train derailment and chemical spill near West Point. It was filed in Hardin Circuit Court on behalf of four people whose lives were disrupted by the derailment.
The plaintiffs were either forced to shelter in place, were evacuated, or were affected when a portion of Dixie Highway was shut down.
The lawsuit names five companies, including the P & L Railroad and CSX Transportation.
Louisville attorney Jasper Ward is seeking to have the suit certified as a class action on behalf of everyone who lives within a five mile radius of the derailment.
