LOUISVILLE, Ky. (WDRB) -- Should Kentucky school shooter Michael Carneal be able to take back his guilty plea and go to trial?

That's what a federal appeals court is considering.

At a hearing Wednesday, Carneal's attorney argued that his client's appeal was timely and should be allowed.

Carneal has schizophrenia and is arguing that he wasn't mentally competent to plead guilty to the shooting at the time, when he was 15.

Carneal killed three classmates at Heath High School in 1997.

A ruling might not come for months.
