POLICE: Louisville man found in women's restroom at Drake's

LOUISVILLE, Ky. (WDRB) -- A Louisville man is in trouble with the law after police say he was found in the women's restroom at an east-end restaurant.

According to an arrest report, it happened at 1 a.m. Saturday at Drake's Restaurant on Shelbyville Road, near Westport Road.

Police say the restaurant staff told an off-duty detective that 38-year-old Gerald P. McCarthy was found in the women's restroom "highly intoxicated."

Restaurant staff also accused him of using his camera phone to shoot video of the woman who was in the stall next to him.

"Drakes' female bathroom is clearly marked for females only, and is completely enclosed by a swinging door," police say.

McCarthy was arrested and charged with criminal trespassing, a misdemeanor, according to the arrest report.

His phone was seized as evidence, police say.
