LOUISVILLE, Ky. (WDRB) -- Jurors have found Joseph Banis guilty of complicity to murder, robbery, and other charges.
It took the jury about ten hours to reach that determination after being sequestered overnight. Banis did not react after the verdict was announced, but simply stood still and didn't say a word. Defense attorneys also did not comment after the verdict.
Prosecutor Ryane Conroy says this case was unlike others she has covered and that it involved a lot of information about sex and drugs.
She says, "The facts and circumstances are things you don't typically talk about in open court, but they were relevant and pertinent to what we were trying to get the jury to decide here, which is the guilt of Joseph Banis."
His sentencing hearing begins at 9 a.m. Monday. Prosecutors plan to push for the death penalty. The jurors will recommend a sentence and the judge will make a final decision.
Deliberations began after attorneys' closing arguments on Thursday.
Banis and Mundt were accused of killing 37-year-old James Carroll during a fight in late 2009. Carroll's body was discovered in the basement of the couple's home in Old Louisville in June 2010.
Prosecutors said the men killed Carroll by shooting and stabbing him, then breaking his knees and stuffing his body into a container.
Mundt is being tried separately. He took a plea deal and testified against Banis so he would not face the death penalty. Prosecutors say the harshest sentence Mundt could get is life in prison.
Conroy says, "His trial is set in May and the Commonwealth intends to proceed to trial on that. We will always continue to re-evaluate our case in light of the fact that all the evidence that got presented here, a lot of it is similar to what will be presented in Jeffrey Mundt's trial."
