Derby Pie dispute settled

LOUISVILLE, Ky. (WDRB) -- A dispute between Claudia Sanders Dinner House and Kern's Kitchen is over.  They've settled Kern's Kitchens' lawsuit over the trademark of the name Derby Pie.

Under the agreement approved by a U.S. District Judge, the Dinner House in Shelbyville and its employees are permanently barred from using the Derby Pie name to promote its chocolate pie made with pecans and chocolate chips.

Kern's Kitchen holds the trademark in the name of the sweet treat, which was created in 1950 at the Melrose Inn in Prospect.

Kern's Kitchen alleged Claudia Sanders Dinner House violated its trademark by using the name.
