All charges dropped against man accused of assaulting 74-year-old

LOUISVILLE, Ky. (WDRB) -- All charges against a 38-year-old Louisville man accused of assault while watching a Christmas Day football game have been dropped, according to a defense attorney.

On Jan. 4, police arrested Lamont D. Johnson and charged him with assault and robbery. At the time, police said that on Dec. 25, Johnson was watching a football game with a 74-year-old man, when he became enraged about comments the man made.

Police claimed Johnson -- the son of the victim's girlfriend -- was sitting in a recliner when Johnson punched him "with a closed fist multiple times." Police say he took the victim's gun before leaving.

But according to Jason Segeleon, Johnson's defense attorney, all charges were dropped during a court hearing Wednesday morning, after the prosecutor determined that it was the victim who was the aggressor, not Johnson. Segeleon said prosecutors determined that the victim leveled a firearm at Johnson's mother, and Johnson acted to protect her.

Segeleon commended both the police detectives and the prosecutor for, in his words, "being thorough" and taking the time to examine all of the facts.
