LOUISVILLE, Ky. (WDRB) -- The man charged with Louisville's first murder of the year was in court Wednesday.

Justen Tandy, 19, is charged with robbery and murder in the death of Brian Przybylek. Police say Przybylek was killed on Jan. 5 when he showed up for a drug transaction.

According to a police report, Tandy and a friend allegedly called Brian Przybylek, saying they wanted to buy some drugs when they really intended to rob him.

When Przybylek showed up at the Guardian Court Apartments, near Preston Highway, police say he fought with Tandy and the other man. During the struggle Przybylek was shot one time.

Offices found Przybylek in the hallway of the apartments. He was pronounced dead shortly after help arrived.

Tandy pleaded not guilty and is being held on $1 million bond.

A memorial fund has been set up at Fifth Third Bank to assist with funeral expenses for Przybylek.
