Gov. Beshear hires Ashland firm in gay marriage appeal

FRANKFORT, Ky. (WDRB) -- Ky. Gov. Steve Beshear says the state has hired a private law firm in appealing a judge's order for Kentucky to recognize same-sex marriages performed in other states.

The Ashland firm of VanAntwerp, Monge, Jones, Edwards & McCann will represent the state's appeal.

U.S. District Judge John G. Heyburn overturned parts of a 2004 state constitutional amendment barring recognition of same-sex marriages performed in other places.

When Ky. Attorney General Jack Conway refused to appeal the judge's decision, Gov. Beshear announced he would seek outside counsel.

Gov. Beshear released the following statement:

"After reviewing multiple responses to our search for private counsel in Bourke vs. Beshear, the state has chosen to execute a contract with VanAntwerp, Monge, Jones, Edwards & McCann, LLP of Ashland, Kentucky.

"This firm will be the state's counsel of record for all aspects of this case going forward, including the issues still pending before Judge Heyburn.  The firm will also serve as state counsel for any separate cases involving these issues, including the pending action in Franklin Circuit Court.

"VanAntwerp, Monge, Jones, Edwards & McCann, LLP has considerable experience in arguing before federal courts, including the Sixth Circuit Court of Appeals, and we are confident they will represent the Commonwealth well."
