Man arrested in death of Indy 500 fan released

INDIANAPOLIS (AP) - Authorities say they released a man accused in a deadly shooting near the Indianapolis Motor Speedway on the eve of the Indy 500 because the police line-up was tainted.

Speedway Police Department Lt. Trent Theobald said Wednesday that witnesses who were supposed to be kept separate before the line-up that included 19-year-old Avory Johnson were mistakenly allowed to mix.

Authorities dropped a preliminary murder charge against Johnson in Saturday's slaying of 25-year-old Max Levine of Kokomo in a parking lot across the street from the track. Johnson was released from jail Wednesday.

Theobald says police still consider Johnson a suspect. No phone number for Johnson was listed in the Indianapolis area and The Associated Press could not reach him for comment.
