Dejuan Hammond's attorneys fight to have murder case dismissed after evidence withheld

LOUISVILLE, Ky. (WDRB) -- Evidence was withheld in the Dejuan Hammond trial. So is there even a case?

Dejuan Hammond's lawyers say no as they fight to dismiss the murder case against him.

Hammond was indicted for the murder of Troya Sheckles, who was shot to death in Shelby Park in 2009. Investigators says she was killed to keep her from testifying against Dejuan's brother, Lloyd Hammond.

Dejuan's trial last fall was dismissed without prejudice because of missing witnesses. Now, he's back in court again for the murder, and if the defense gets its way, it could be for the last time.

"Now here we are again with this incredible story," said Ted Shouse, Hammond's attorney. "The Commonwealth wants a fifth bite at this apple. I think enough is enough."

If the judge dismisses the case, the murder charge would be dropped.
