Two-month-old remains on life support as Louisville father appears before judge

LOUISVILLE, Ky. (WDRB) --  A hearing on Monday could help decide if a 2-month-old baby allegedly abused by his father.. will be pulled off life support.It's a fight in court for baby Isaac Lopez. This morning, Alex Lopez Rosales, the baby's dad, was in court as attorneys talked about his warrant and indictment yesterday of criminal abuse. Police say last month, he hit his 2-month-old son's head against a bathtub, fracturing his skull.

The child remains at Kosair Children's Hospital. The boy's family filed a temporary restraining order against Norton Healthcare to prevent him from being removed from life support. A judge decided that order was not necessary and it was dissolved.

The boy's mother was at her husband's court appearance. She was with her attorney and wants more time for her son to recover.

Norton has filed a motion to withdraw life support, but is waiting on the court to decide. A Norton spokesman says Isaac is medically brain dead and requires constant medical attention. The baby's family is working on getting a second opinion.

The father needed a translator this morning to understand the court proceedings.

"The bond fixed at the request of the grand jury is $100,000, full-cash," said Judge McKay Chauvin of Jefferson County Circuit Court. "I'm going to leave that in place, but I'll fix the Circuit Court bond when we meet again on Monday."

Rosales will be arraigned Monday afternoon.

Monday morning is the life support hearing. The baby has been appointed his own attorney to make sure the court makes decisions in the best interest of the child.  The mother and father each have a different attorney in the case.
Norton's attorney will also be there.
