Court to decide fate of 2-month-old on life support

LOUISVILLE, Ky. (WDRB) -- It's now up to a court to decide the fate of a 2-month-old baby boy on life support.

Circuit Judge Judith McDonald Burkman is reviewing responses from attorneys on the case.

Norton Healthcare is arguing that baby Isaac Lopez is brain dead and should no longer be on life support.

But the mom's attorney, along with the attorney assigned to represent the infant, agree that the decision of whether or not to remove the child from life support should be up to the parents, not the hospital.

Police say the baby's father, Alex Lopez Rosales, hit his 2-month-old son's head against a bathtub, fracturing his skull, last month.

There's no word yet on when Burkman will make a decision.
