Ky. death row inmate loses hip surgery lawsuit

LOUISVILLE Ky. (WDRB) -- A Kentucky death row inmate will not be getting surgery on his degenerating hip.

57-year-old Robert Foley filed a lawsuit claiming the state's inability to find a hospital amounted to cruel and unusual punishment.

Foley was convicted of killing six people in eastern Kentucky in 1989 and 1991.

Court documents show Foley's status as an extremely dangerous prisoner was a big factor in the state's difficulty in finding a surgeon and hospital.

A judge found that the state tried to find a facility for Foley but wasn't able to do so.
