LOUISVILLE, Ky. (WDRB) -- A former KSP trooper indicted for a sexual relationship with a 15-year-old girl wants his case dismissed.

This morning, Stratford Young's attorney argued "a police officer" is not included in the definition of "being a person of authority." It's not in the wording of the statute, so his attorney says it's unconstitutional to include him.

Young and former Brandenburg Officer Todd Matti remain free on bond after being indicted for a sexual relationship with the same 15-year-old girl.

Neither men were in court today.

The judge says he'll rule on Young's case at a later date.
