Prosecutors face tough decisions in Ricky Kelly murder cases

LOUISVILLE, Ky. (WDRB) -- Louisville's notorious drug dealer, Ricky Kelly, returned to court Monday morning, charged with murder -- and prosecutors are grappling with a decision they have to make.

Kelly is charged with the 2005 murder of LaJuante Jackson. Police say Kelly shot Jackson to protect a drug trafficking organization.

The case started at the state level, then went to federal court and has now been seen sent back to the Commonwealth.

Since 1996, Kelly has been charged with eight murders. Prosecutors say they are still investigating whether or not to try the other cases in state court.

"We are evaluating these cases," said Leland Hulbert, assistant commonwealth's attorney. "It takes a lot of time, and we want to make sure it's all done transparently and the right way -- and this is the case that's now pending. This case has been indicted and this is our main focus."

The decision on whether or not to try this case as a death penalty case is still being discussed and prosecutors say they will make a decision by November first.

A trial date has been scheduled for next June.
