Indiana delays action on toll contract amid protest

LOUISVILLE, Ky. (WDRB) – Indiana will delay a key vote on the company chosen to operate tolls on bridges between Louisville and Clark County, Ind., the state's top finance official said Tuesday.

A bi-state board of Kentucky and Indiana officials last month selected Virginia-based Kapsch TrafficCom IVHS Inc. as the toll system provider for the $2.3 billion bridges project, which will add tolls to new spans downtown and between Prospect, Ky., and Utica, Ind., and a resurfaced Kennedy Bridge.

The Indiana Finance Authority, which is leading the procurement, had tentatively scheduled to vote on the contract at its Oct. 16 board meeting in Indianapolis. But state is still looking into a competing company's formal protest of the selection and won't take up the Kapsch contract on Thursday, finance director Kendra York said in an email.

"We take the claims made in the protest of the selection process very seriously and feel they warrant diligent and in-dept(h) inquiry,” York said. “Therefore, the tolling-services provider for the Ohio River Bridges Project will not be on the agenda for consideration at this month's IFA board meeting. We anticipate a decision on the matter before the end of October."

TransCore LP of Nashville – one of three losing bidders on the contract valued at nearly $40 million – argued in a Sept. 25 letter that Kapsch failed to disclose two conflicts of interest in its proposal. TransCore President Tracy S. Marks also alleged “deficiencies” in the Kapsch proposal, such as having a company operate a customer service center that “has never provided a single system that meets the customer service center requirements” of the Louisville project.

The Kapsch contract originally had been expected to be finalized in November.

Kapsch has previously declined to comment on the protest.
