LOUISVILLE, Ky. (WDRB) -- A Louisville man has been charged with murder after a deadly crash that happened two weeks ago. Mark Highbaugh is charged with murder after the passenger in his vehicle, 42-year-old Paul Ward, died.

The crash happened Dec. 7 on North Beckley Station Road. According to a police report, Highbaugh lost control, went off the road, down an embankment and hit a tree.

Ward was trapped inside and had to be cut out of the vehicle by firefighters. Both men were taken to University of Louisville Hospital with injuries from the crash. Ward died three days later.

A grand jury looked over evidence in the case and, less than two weeks later, indicted Highbaugh on charges of murder and DUI. According to court documents Highbaugh was arrested Monday and was released the same day after posting bail.

Highbaugh is due in court next month. Some may recognize Highbaugh's name as the Building Industry Association of Greater Louisville confirms he was a home builder in the Louisville area.

Ward is survived by his wife and two children.Ward's wife released this statement to WDRB, she says, "Paul will be greatly missed especially at Christmas, but he was an organ donor and his gift of life will be greatly appreciated by eight people this year."

WDRB was unable to get in touch with the Highbaugh family.
