ISP: Driver charged with OWI fled arresting officer, leaving child alone in car

LOUISVILLE, Ky. (WDRB) – Indiana State Police says a drunk driver fled an arresting officer Sunday afternoon, leaving a four-year-old alone in the vehicle.

About 4:30 p.m. on Jan. 4, ISP Trooper Stephen Wheeles stopped a car on Country Squire Boulevard for a traffic violation. When the trooper got the driver's license and registration, he noted James Earl seemed intoxicated.

After a roadside sobriety test, Trooper Wheeles decided to further investigate. As he was handcuffing Earl, the suspect broke away and ran, leaving a child alone in the car.

Trooper Wheeles tracked down Earl with the help of his K-9 unit, Kane. Earl was bitten by Kane and refused medical treatment.

Earl also refused to take a breath test, he was later incarcerated in the Jennings County Jail.

Earl is facing one count of Operating While Intoxicated. He also faces Neglect of a Dependent, Resisting Law Enforcement (fleeing on foot) and Possession of Marijuana.

Earl's four-year-old son, who was left inside the car, was released to Child Protective Services on the scene.
