Co-defendant of Chris Jones told police sex with women was '100 percent consensual'

LOUISVILLE, Ky., (WDRB) -- One of Chris Jones' co-defendants in his rape case told University of Louisville police that it appeared Jones had "100 percent consensual" sex with a woman in a bathroom, but that she later cursed him after briefly leaving the apartment and then coming back.

Jalen Tilford said Jones "ended up calming" the woman down and she and another female came back into the Cardinal Towne apartments on Feb. 22, according to a summary of his April statement to police. Jones later went into the bathroom with the other woman and when "they came out both seemed fine," Tilford said.

After most everyone had left the apartment that night, Tilford noticed blood on the bottom of Jones' shirt as he was "trying to tuck it in." 

Tilford is testifying today in front of a Jefferson County grand jury, which is in its third day of considering whether to indict him, Jones and Tyvon Walker on charges of rape and sodomy in the alleged assaults of two women Feb. 22 at Cardinal Towne apartments.

WDRB obtained Tilford's statement to police from his attorney, Scott Drabenstadt. Drabenstadt would not comment on what Tilford would tell the grand jury. 

Tilford said in his statement to University of Louisville Det. John Tarter that the night began when Walker brought the two women to the apartment where about 10 people were drinking beer, having come from a party at the "Hockey House." 

Walker, according to Tilford, went into the bathroom "to have sex" with one of the women, identified only as the "Brazilian." He claims when the woman came back out, "she was smiling and talking."

The other woman, identified as the "blonde haired girl" later asked to use the bathroom and Jones followed. Tilford said a few minutes later he went to adjust the volume of the music in his bedroom and the woman who Walker had been with followed him. Tilford said he and the woman had sex and it was "100 percent consensual and at no time did I think she was too drunk to know what she was doing." 

Before he left the bedroom, Tilford said he looked into the bathroom and saw Jones having sex with the blonde woman. She asked Tilford to shut the door, he claims. "It appeared 100 percent consensual to me."

After a few minutes, Jones and the women walked out, according to Tilford.

"Her demeanor was fine," Tilford told police. "She was not angry or upset. She sat back down in a chair and seemed fine." 

The two women left the apartment a few minutes later, Tilford claims, telling people "bye."

"Everything seemed fine," he said. 

But five minutes later, Tilford opened the door and the blonde woman was in the hallway "cussing at Chris – saying 'f--- you' and he was saying "what did I do?"

When Tilford tried to calm the woman down, he said she cursed him and "tried to fight with me (physically)."

Jones calmed the woman down and she and the other woman, identified only as the "Brazilian" in the statement, came back into the apartment, according to Tilford. 

As the blonde woman sat on the couch and watched TV, Jones ended up going into the bedroom with the other woman, Tilford told police. 

Tilford said the blonde woman knew Jones and the other female had gone into the bedroom, where they stayed for about 15 minutes. 

"When they came out both seemed fine," he said. "The 'Brazilian' girl was not angry or anything like that."

After the women left a short time later, "they were not angry or upset or saying anything except 'bye' and 'nice meeting you,'" Tilford told police.

Tilford said the entire time the women were at the apartment that night, he "never thought anything was wrong."

When the blonde woman cursed Jones, he believed it was because Jones "had been rude to her or she was just drunk. Sometimes Chris can be big-headed and rude to women. I do not believe, however, that he did anything forceful of against any girl's will sexually."

After most everyone had left the apartment that night, Tilford said that's when he noticed blood on the bottom of Jones' shirt as he was "trying to tuck it in." 

Assistant Jefferson Commonwealth's Attorney Ryane Conroy said Tuesday that the grand jury will likely report its decision today at 1 p.m. 

Jones is charged with two counts of rape and two counts of sodomy. One of the alleged victims claimed to identify Jones "because she recognized him as a University of Louisville basketball player" and he told her his name. That woman was examined at the university, one warrant says. 

The attorneys for two alleged victims, Will Walsh and Dina Bartlett, have repeatedly complained that Jones has been given preferential treatment, including being released from home incarceration without the victims being properly notified. 

But Commonwealth's Attorney Tom Wine said last week that the case was being handled properly and "there has not been, nor will there be, any special procedures or accommodations made for these defendants or their attorneys." 

Scott C. Cox, an attorney for Chris Jones, has predicted the grand jury will dismiss the case after hearing all of the evidence, including from witnesses at the party the night of the alleged rapes who would support his innocence.
