Olmsted North teacher under investigation, accused of assaulting student

LOUISVILLE, Ky. (WDRB) -- A JCPS teacher is under investigation after the mother of a student in eighth grade at Olmsted Academy North says the teacher assaulted her son.

"Mr. Payton came behind him and picked him up out of his chair and threw him and then he came in to attack him again," the student's mother Susie Coleman said.

The teen's mother is preparing to file a lawsuit against the district over what happened to her son at Olmsted Academy North.

The mother says her son, an eighth grader, was in class May 13 when he was asked to go to detention.

She says when he said he didn't want to go, he was assaulted by teacher Jason Payton.

JCPS says the 15-year-old student suffered injuries that required him to go to the hospital.

LMPD started investigating the incident but deferred the case back to JCPS. The school district says it is investigating, but that Payton has not been placed on leave.

"I think there's a very disturbing trend at Olmstead North, where kids are subjected to this kind of force and its very troubling," attorney Thomas Clay said. "Apparently this is not an isolated incident."

Olmsted Academy North is the same school where a metro police school resource officer, Jonathan Hardin, was arrested and indicted on two charges of assaulting students.

The incidents were captured on school surveillance video.
