MOREHEAD, Ky. (WDRB) – As Rowan County Clerk Kim Davis continues to refuse marriage licenses, Ky. Governor Steve Beshear says her future “is now in the hands of the courts.”

Beshear says he will not call for a special session of the General Assembly.

“I see no need to spend hundreds of thousands of dollars of taxpayers’ money calling a special session of the General Assembly when 117 of 120 county clerks are doing their jobs,” Beshear said in a statement Tuesday evening.

After the U.S. Supreme Court refused to grant Davis a stay of a ruling, effectively ordering her to issue marriage licenses, she again refused to issue marriage licenses Tuesday morning.

The American Civil Liberties Union has filed a lawsuit asking that Davis be held in contempt.

Rowan County Attorney Cecil Watkins says the federal court alerted him that a hearing is scheduled for 11 a.m. Thursday in Ashland.

Watkins says clerk Kim Davis has been summoned to attend, along with all the deputy clerks who work in her office. The summons comes after two gay couples asked a federal judge to punish Davis by fining her, but not sending her to jail.

“There are obviously strong feelings on both sides of this issue, but the United States Supreme Court has spoken and same-sex marriage is now legal in Kentucky and the rest of the United States,” Beshear said.
