Attorneys for Kim Davis file appeal to the order that jailed her Thursday

LOUISVILLE, Ky. (WDRB) - Rowan County Clerk Kim Davis has appealed the order that jailed her for not issuing marriage licenses to gay couples.

Davis was sent to jail Thursday for contempt after insisting that her "conscience will not allow" her to follow a federal judge's orders to issue marriage licenses to gay couples.

Attorneys for Davis officially filed the appeal Sunday. The three-page motion does not include arguments as to why Davis should be released but amends Davis' earlier appeal of the judge's order.

U.S. District Judge David Bunning said she left him with no alternative but to jail her, since fines alone would not change her mind.

"Her good faith belief is simply not a viable defense," Bunning said, noting that allowing an individual's beliefs to supersede the court's authority would set a dangerous precedent.

Liberty Counsel, the group representing Davis, says Judge Bunning has not entered a written order, even though Davis has been jailed.

“Mrs. Davis is entitled to proper notice and due process when she is threatened with the loss of her freedom," founder Mat Staver said. "There was no indication that she would be incarcerated. We will be presenting our arguments on appeal and asking for an expedited ruling."
