Oldham County attorney accused of racial profiling with courtroom remark

LOUISVILLE, Ky. (WDRB) -- There are claims of racial profiling in Oldham County and the county attorney is accused of admitting it.

Attorney Dawn Elliott says courtroom video proves her argument.

In the video of the Oct. 14 court appearance, you can hear an attorney say, “I think that their main issue is that they were stopped because they're Hispanic.”

Elliott says,”Yeah, that’s our issue.”

Oldham County Attorney John Carter then says,”It’s probable cause.”

Elliott responds with,”I’m going to act like I didn’t hear that.”

Elliott believes Carter was saying being Hispanic is probable cause to be pulled over in Oldham County.

"It's our contention that he was stopped because he was driving while brown,” said Elliott in an interview with WDRB Thursday.

Her client, Mauro Martinez, was pulled over by Oldham County Police Officer Adrian Doleman in July. The citation says Martinez was speeding but Martinez claims he wasn't.

Doleman ended up citing Martinez for not having a license.

"The officer on the citation stated that he was speeding yet he didn't charge him with a moving violation,” said Elliott.

John Carter told WDRB those accusations are incorrect. He claims he was referring to the moving violation on the citation, not the comment about being Hispanic.

But Elliott thinks this is just a small glimpse into a bigger problem.

"Since this story came to light, there have been a lot of attorneys who practice in both Jefferson County and Oldham county who say they see quite a few more Hispanic individuals when they go out to court,” she said.
