Teen formally charged in connection with fatal hit and run in Jeffersonville

JEFFERSONVILLE, Ind. (WDRB) -- The teenager charged in connection to a fatal hit and run entered a not guilty plea in court on Wednesday. 

Eighteen-year-old Brandon Bailey appeared at the Clark County Court House for an initial hearing. The judge told Bailey he is charged with failure to stop after an accident causing death, which is considered a level 5 felony.

It's for his involvement in the hit and run accident that killed 64-year-old Junior Lee Montgomery. Montgomery died Saturday after he was hit on Spring Street, not far from Hamburg Pike.

Montgomery lived about half a mile away from the area.

Bailey's attorney said the teen panicked after the accident and called police himself, when he got home.

Police say Bailey's pick-up truck had a damaged windshield as well as damage to the front passenger side. 

Bailey has no prior record and faces a possible 1 to 6 years in jail if convicted.

His next hearing is set for February 4th. Bond was set at $7,500.
