Man charged in murder of Harrison County, Ind. couple withdraws guilty plea

LOUISVILLE, Ky. (WDRB) -- The family of a Harrison County couple murdered in 2013 filed into a courtroom Thursday expecting to gain some closure. 

Instead, they left shocked and upset when Austin Scott withdrew his guilty plea just before he was set to be sentenced. 

Police say Scott and Kevin "Drew" Schuler broke into Gary Henderson and Senie Arnold's home near New Salisbury in August of 2013. According to police, the men were going to steal guns and prescription drugs, but the situation escalated and Scott stabbed Henderson to death, and Schuler beat Arnold to death.

Schuler's trial is set for May and Scott had agreed to plead guilty to murder in exchange for a life sentence without parole. 

But he apparently changed his mind.

"Mister Scott made the judge aware that he wished to withdraw that guilty plea. He said that he was pressured into it. So this came as a complete and total surprise for the state,"  Harrison County Prosecutor Otto Schalk said. "The first we heard of it was seconds before we walked into the courtroom. So as you can imagine it was sort of a jaw dropping experience to go through that."

A hearing is set for next Friday to review the matter. By law, the judge does not have to accept the plea withdrawal.

The case gained a lot of attention from the community. Henderson was well known for his horse and carriage company and worked weekends at the Huber family farm for 20 years.

The prosecutor is prepared to take Scott to trial in March, should the judge decide to accept the change of mind.
