LAWSUIT: JCPS knew student had violent tendencies prior to sexual assault

LOUISVILLE, Ky. (WDRB) – Jefferson County Public Schools knew a Pleasure Ridge Park High School student had a history of sexual assault and did nothing to prevent the assault of another student, according to a lawsuit filed against the school district.

The lawsuit, filed in U.S. District Court by “Jane Doe,” claims the district knew the alleged perpetrator had exhibited “violent and sexually assaultive behavior towards other JCPS students” and should have done something to prevent further incidents.

When the plaintiff was allegedly assaulted on her way to class on April 18, the lawsuit claims it was captured on surveillance video; but, after staff at the school saw the video, it was “lost or destroyed.”

The suit claims JCPS already knew of two incidents prior to the alleged sexual assault but did nothing to remove the other student from the school.

Attorney Andrew Thomas Lay filed the lawsuit on behalf of the student who was allegedly assaulted and claims the school and the district should have taken “appropriate corrective action to protect the other students” before the plaintiff was assaulted.

JCPS does not comment on pending litigation.

The lawsuit seeks compensatory damages and punitive damages through a jury trial.
