LMPD officer arrested for DUI in Floyd County, Ind.

LOUISVILLE, Ky. (WDRB) -- A Louisville Metro Police officer was arrested for DUI in Floyd County, Indiana, over the weekend, according to an LMPD spokesperson.

Officer Christopher L. Davis has been placed on administrative leave, according to Dwight Mitchell.

According to a probable cause affidavit obtained by WDRB News, the incident took place on Saturday, Jan. 30, at 11:30 p.m. on Spring Street, near State Street, in New Albany.

An Indiana State Police trooper allegedly saw a vehicle swerve into the opposing lane of traffic, then exit onto I-64 westbound. Police say the license plate on the vehicle had expired, so the trooper pulled the driver over.

That driver turned out to be Davis, according to the affidavit. Police say he identified himself as a Louisville Metro Police officer. He allegedly told the trooper that he had been texting and driving, but the trooper said he "had the look of intoxication" -- specifically, glassy eyes. 

Police say Davis admitted to drinking alcohol, but then became uncooperative with the investigation.

"Mr. Davis refused to step from the vehicle," the probable cause affidavit states. "I ordered him out. As I was speaking with Mr. Davis, I smelled an odor commonly associated with an alcoholic beverage coming from his breath."

Police gave Davis a preliminary breath test, indicating that he had a .14 percent Breath Alcohol Concentration, according to the affidavit. Police say he was later given a certified breath test which indicated an alcohol concentration equivalent to .123 grams of alcohol per 210 liters of breath.

Davis was arrested and taken to the Floyd County Jail. He is charged with Operating a Motor Vehicle with an Alcohol Concentration Equivalency of .08 or more, a class C misdemeanor.

Mitchell says the LMPD Public Integrity Unit is investigating.
