Planned Parenthood of Indiana and Kentucky hires high-profile attorney to fight lawsuit

LOUISVILLE, Ky. (WDRB) - Planned Parenthood of Indiana and Kentucky hires a high-profile attorney in Louisville after the state of Kentucky files suit against the organization.

Attorney Thomas Clay says Planned Parenthood of Indiana and Kentucky wants to operate within the law and has been cooperating with state officials to get its license. He says the organization did not know its cooperation would result in a lawsuit.

The suit, filed Thursday by the state Cabinet for Health and Family Services, claims Planned Parenthood performed 23 abortions illegally between Dec. 3 and Jan. 28. It says the Louisville facility on 7th Street was operating without a license. 

Clay says Planned Parenthood was operating without a license, but says there is a reason. He says the state, under Gov. Steve Beshear's administration, told Planned Parenthood that in order to get a license, it needed to have an unannounced inspection.

To have an unannounced inspection, it had to be operating.

"I don't know how the Bevin administration proposes to resolve this apparent inconsistency in the law that you have to have an unannounced inspection before you can have a license," Clay said. 

"I'm not sure how that will play out, but I am confident in one thing and that is the Bevin administration will never approve this license."

The state also says the facility did not have the necessary agreements with a local hospital or ambulance service in case of an emergency. Clay says that paperwork had been approved by the state under Beshear's administration.

The organization has resubmitted everything needed for a license. The state wants Planned Parenthood to be fined the maximum amount allowed by the law.
