LOUISVILLE, Ky. (WDRB) -- A judge declared a mistrial Tuesday in the case of a former JCPS bus driver who police say allowed two students to engage in sexual relations in the seat behind her while she was driving.

According to an arrest warrant, the incident took place on Aug. 22, 2014, on school bus no. 0039. Police say 31-year-old Kristy Lawrence, "did not make substantial effort to prevent the sexual misconduct and/or sexual abuse of a 12-year-old female."

After a two-day trial, jurors were unable to reach a verdict Tuesday night.

Police say that while Lawrence was driving the bus, a male student persuaded a 12-year-old female student to perform oral sex on him.

"The incident lasted approximately eight minutes and is on surveillance video," the warrant states.

Police say the sex act took place in the seat directly behind Lawrence, and she knew of the 17-year-old's intentions.

There's no word on whether prosecutors will try the case again.
