Planned Parenthood files motion to dismiss lawsuit claiming it filed 'unlicensed' abortions

LOUISVILLE, Ky. (WDRB) -- Planned Parenthood says a lawsuit filed by the state of Kentucky must be dismissed.

The attorney for Planned Parenthood of Indiana and Kentucky says his client followed all of the rules, but the state of Kentucky did not. 

The lawsuit itself was filed earlier this year by the state of Kentucky and the Cabinet for Health and Family Services. It claims Planned Parenthood performed 23 abortions illegally between Dec. 3 and Jan. 28.

It says the Louisville facility on 7th Street was operating without a license. 

Thomas Clay, an attorney for Planned Parenthood says that's true, but it's because under the administration of Gov. Beshear the organization was told to get its license, it would need an unannounced inspection.

"It was only after the change in administration from Governor Beshear to Governor Bevin that the Cabinet took a 180-degree turn and basically undid all of the things that the prior Inspector General said that Planned Parenthood should do in order to secure a license for operation of this clinic."

And the center had to be operating in order for that to open. 

The motion filed Tuesday claims Gov. Matt Bevin and the Cabinet ignored the fact that the Attorney General is the one who is supposed to file a lawsuit like this one and that this is politically motivated.

Gov. Bevin's office released the following statement in response to the motion on Tuesday: 

“Planned Parenthood’s motion to dismiss has no merit. The only thing jaw-dropping about this case is the fact that Planned Parenthood performed abortions without the required emergency agreements in place to protect women. The law is the law. Planned Parenthood does not dispute that it performed abortions without a license and without the required emergency agreements.  These are clear violations of the law, and Planned Parenthood is desperately trying to distract attention from this fact.”
