FRANKFORT, Ky. (WDRB) -- Kentucky Attorney General Andy Beshear announced Monday he has filed suit against Gov. Matt Bevin, challenging his decision to immediately cut the higher education budget by 4.5 percent.

Beshear said in a news conference that Bevin's cuts "violate our separation of powers."

"As the state's top consumer advocate, it is my job to point out who these cuts will hurt," Beshear said. "Put simply, these actions against universities are illegal."

Beshear added that under the governor's cuts, tuition will assuredly go up, claiming students will bear the full burden.

"It is a direct challenge to our liberty and our way of life."

Legislative leaders agreed late Monday afternoon to push back the final day of the General Assembly’s 2016 session until Friday so that lawmakers can continue working toward passage of the state’s next two-year budget.

Friday is the last day that lawmakers can meet for the final day of this year's Regular Session. Lawmakers have already met for 59 of the 60 days allowed by the constitution for this year’s regular session.

Gov. Bevin released a statement Monday evening:

“As best we can make sense of his rambling press conference, we strongly disagree with the Attorney General and will respond as necessary in court. Given the amount of alleged corruption and personnel problems in the Office of Attorney General and his father’s administration it is clear that he is attempting to deflect attention away from his own challenges.”

A hearing on Beshear's suit is schedule from 10 a.m. Thursday.
