Louisville robbery suspect keeps having cases dismissed

LOUISVILLE, Ky. (WDRB) -- His criminal history is 13-pages long and includes several robberies.

Michael Cain was released from Metro Corrections this week and was back in custody by Wednesday afternoon.

"The manager of the store said that a gentleman came in with his hands in his pocket and asked us to give him all his money, all our money," said David Owsley, who is a Firestone employee.

Cain is accused of trying to rob the Firestone on East Broadway on Wednesday afternoon.

"The sales person said he couldn't do that ... and the guy said, 'I'm not kidding, I have a gun,'" Owsley said.

After leaving Firestone, Cain allegedly went across the street to Long John Silver's and tried the same thing. He was eventually arrested by LMPD.

Cain was arraigned on Thursday morning.

Despite his long criminal history that includes several robbery arrests, most have been dismissed.

In fact, Cain was in court on Monday, just days before the alleged holdups at Firestone and Long John Silver's.

"(I) don't want to release Mr. Cain, as I think am required to do, and have him immediately back in the system," said Judge Brian Edwards during the hearing.

A University of Louisville doctor testified that Cain suffers from mental illness.

"He is not delusional, he is not hallucinating, he simply has bad judgment and compromised intellectual abilities, and medicines don't improve either of those," the doctor said.

"As a district judge, I did deal with mental inquest warrants from time to time," Judge Toni Stringer said.

Stringer looked at Cain's criminal history with us and explained why the system continues to release him.

"The law says if someone is not competent to stand trial, that you can not prosecute someone who is not competent to understand the criminality of what they've done."
