LOUISVILLE, Ky. (WDRB) -- The man who pleaded guilty to shooting a student at Fern Creek High School in 2014 was sentenced Wednesday.

Jefferson Circuit Judge Judith McDonald-Burkman said as long as Andre Banks stays out of trouble for the next five years, he won't go to jail, but ordered him to serve the first 100 days of his 18-year-sentence on home incarceration. If he gets in any trouble within five years, he will be sent to prison to serve 18 years.

Banks shot another student, Javaughntay Burroughs, at Fern Creek High School in September of 2014.

In March of 2016, Banks pleaded guilty to first degree assault, first degree wanton endangerment, tampering with physical evidence, possession of a weapon on school property, possession of a handgun by a minor and carrying a concealed deadly weapon.

Banks originally told police he was trying to shoot another student -- not Burroughs -- during an altercation on Sept. 30, 2014, but he accidentally shot Burroughs in the stomach. 

"I shot the wrong person," Banks told Louisville Metro Police, according to an interview filed in his case.

Banks told police he "got mad" because he believed the other student had given him a counterfeit $100 bill in exchange for an iPad.

For the past nine months, the plea agreement has allowed Banks to stay in a juvenile detention center. During that time, he has been working towards a college degree and has already been promised a job once the case is over.

Family members of Burroughs, who was 15 when he was shot, told prosecutors they want Banks to have a chance at becoming a productive citizen.

Banks offered an apology to the school and Burroughs' family during Wednesday's proceedings. 

"I would like to apologize to the students and staff, and foremost the victim, for my selfishness and the immature acts I committed on the dreadful day of September 30, 2014," Banks said. "I would like to make amends to the whole community, the world and the nation for my selfish acts." 

Banks will get credit for time already served.
