LOUISVILLE, Ky. (WDRB) -- Shively Police say a burglar got more than he bargained for when a resident of the home he was burglarizing decided to fight back.
According to an arrest report, it happened at an apartment on San Jose Avenue, near Dixie Highway, just after 7 p.m. on Thursday.
Police say they were called to the scene on a report of a burglary.
The victim told police that when he got home, he noticed that his front door had been damaged. When he went inside, police say he could hear someone in his mother's bedroom.
That's when, police say, the victim grabbed his handgun and looked inside.
According to the arrest report, the burglar, 18-year-old Joe M. Ware, was in the closet, filling up a bag of clothes.
The victim ordered Ware, at gunpoint, into the living room so that he could call police.
While the victim was on the phone, Ware allegedly tried to grab the handgun, so the victim hit him with it, firing the weapon in the process.
Police arrived a short time later, and found Ware trying to run away from the resident of the home, but he was caught by the arriving officers.
Ware was arrested and charged with first degree burglary. He is currently being held in Louisville Metro Corrections.
