LOUISVILLE, Ky. (WDRB) -- Kentucky Attorney General Andy Beshear is vowing to keep fighting what he calls an "illegal ruling" giving the governor the power to cut money for higher education.

"We cannot and should not balance our budget on the backs of students and their families, especially when those cuts are not allowed under law," said Beshear.

Beshear sued Governor Matt Bevin when the governor ordered cuts to public colleges and universities without the legislature's approval. Franklin Circuit Court Judge Thomas Wingate ruled yesterday the governor can make the move, saying two state laws allow it. 

Beshear plans to appeal, and he expects the case will reach the state Supreme Court. He says the judge's ruling gives the governor dangerous levels of power.

The $18 million in question can't be spent on anything else until the case moves through the courts.
