Ohio man facing felony charge in connection with fatal 'Pope Lick' train incident

LOUISVILLE, Ky. (WDRB) -- A Moraine, Ohio man has been charged with a felony weeks after a Dayton woman died when a train hit her on the Pope Lick train trestle in far eastern Jefferson County, Kentucky.

On April 23, police say a train approached 41-year-old David Knee and 26-year-old Roquel Bain on the trestle. Knee and Bain laid down on the tracks to avoid getting hurt. The train hit Bain, and she fell from the trestle. She was pronounced dead at the scene. 

Knee was not hurt, however.

On April 29, a criminal summons was issued for Knee, charging him with, "Unauthorized disruption / delay / prevention of the operation of a railroad vehicle on a track with risk of serious physical injury or death, or damages exceeding $1,000." 

According to the summons, Knee entered the property of Norfolk Southern railroad at South Pope Lick Road by going around a fence with a posted "No-Trespass" sign, then climbing to the top of the hill, "where another no-trespass sign is clearly posted." He and Bain then began to walk along the track as the train was approaching.

"The engineer of the train executed a rapid stop of the train upon seeing the defendant and his companion on the tracks," the warrant states. It goes on to say that Knee laid down on the track and avoided being struck, while Bain died at the scene.

"The engineer immediately contacted dispatch and reported the incident," the warrant states. 

The train was stopped for three hours and two other trains were also delayed, according to the warrant.

Knee has not been arrested. Instead, he has been summoned to appear in Jefferson County District Court in July on the felony charge. He was already charged with second degree criminal trespassing in connection with the incident, according to the warrant.
