JCTA to file suit against JCPS over salary negotiations

LOUISVILLE, Ky. (WDRB) -- The Jefferson County Teachers Union is filing a lawsuit against JCPS, alleging Superintendent Donna Hargens violated their agreement.

JCTA says the district is not providing step increases for educators that were promised in the JCBE-JCTA agreement.

Here's a portion of the statement from union president Brent McKim:

"The decision Superintendent Hargens made to unilaterally violate the JCBE-JCTA Agreement by not providing the step increases earned by educators through their dedicated service in 2015-16makes it clear that the superintendent values the minimal (if any) financial cost of step increases more than she values repairing trust and morale among JCPS employees."

JCTA instructed its attorneys to follow suit against the district.

"One party, in this case the school district, can not decide on its own that it's going to discontinue the salaries and the step increase under the teacher's contract or the labor contract," said Don Meade, the attorney for JCTA. 

"You particularly can't do that in the middle of labor negotiations, when you've made no proposal even to do it."

JCPS says it has "not been notified of a lawsuit."

Spokesperson Alison Martin says the situation of teachers not receiving their pay increases in early July has happened several times in the past, most recently in 2013.

That year, she says, the increases were paid retroactively once the school board approved the salary schedules at its meeting in mid-July.

JCTA is calling on all its members to attend the JCBE board meeting on July 26 to rally against JCPS. McKim is also asking members to call and email school board members and Hargens to protest the action.

Meade says he plans on filing the lawsuit next week in Jefferson Circuit Court.
