LMPD officer who was cleared of perjury charges suspended for 30 days
Police Chief Steve Conrad suspended Officer Leslee Wagner for 30 days on June 23 for "using profanity" and conduct unbecoming, actions the chief said caused the officer to be indicted.
LOUISVILLE, Ky. (WDRB) -- A Louisville Metro Police officer who was accused of lying to a grand jury before having the charges dismissed following two mistrials will be able to keep her job, but was suspended 30 days after an internal investigation by the department.
In April, the Jefferson Commonwealth's Attorney's office decided against taking Officer Leslee Wagner to trial for a third time, saying it was doubtful there would be a different result.
Wagner had been slated to face a third trial in connection with allegations that she committed perjury and false swearing, and that she lied during a grand jury presentation regarding an arrest she made in 2013.
Police Chief Steve Conrad suspended Wagner for 30 days on June 23 for "using profanity" and conduct unbecoming, actions the chief said caused the officer to be indicted, according to a disciplinary report obtained under the Kentucky Open Records Act.
A 30-day suspension is the harshest disciplinary action police can take short of termination.
The department's internal investigation did not sustain allegations that Wagner lied to a grand jury or had been untruthful in a police citation.
Wagner's defense attorney, Steve Schroering, has said she committed no criminal offense.
The charges revolved around an incident in which Wagner and her husband, Larry, who was also an LMPD officer at the time, arrested repo man Adam Hannahs at their apartment complex in 2013.
Records state a car alarm was going off. Hannahs claimed to be there to tow the car.
The Wagners were both off duty at the time but claim Hannahs was uncooperative with them -- so they arrested him and charged him with assault, disorderly conduct and resisting arrest.
Hannahs was later indicted as a result of Leslee Wagner's testimony to a grand jury.
But later, video surfaced that Hannahs took during the incident.
"I'm going to shoot you in your f****** face you re****," Leslee Wagner can be heard saying.
It shows a confrontation between Hannahs and the Wagners.
"I will place you under arrest if you don't give me an ID," said Larry Wagner.
"For what?" asked Hannahs.
"Get on the Godd**** ground motherf*****. Now," said Leslee Wagner in the video.
An internal LMPD investigation found Wagner's testimony did not match what the video shows.
Hannahs' charges were dropped and Leslee Wagner was charged with perjury and false swearing..
