Newly re-installed Shepherdsville Mayor Scott Ellis absent from work on Thursday

LOUISVILLE, Ky. (WDRB) -- Who is running the city of Shepherdsville? Questions remain after a judge said the former mayor didn't really resign.

The once-former mayor, Scott Ellis, is now, legally back in his old job, but on Thursday at least, Ellis was not back in his old office at City Hall.

Mayor Ellis did not show up for work the day after a judge re-instated him. A receptionist says she has no clue as to when -- or if -- Ellis will be there, and she has no idea who is in charge. She's not alone.

City Councilman Bernie Brown wants Ellis to either show up or resign -- again -- by early next week.

"Who's in charge right now"" WDRB's Lawrence Smith asked.

"That's a good question," Brown said. "I don't think anybody is -- and it's a big concern."

"If he doesn't show up pretty soon, I think the council needs to call a special meeting and start doing something," Brown added.

"What can you do?" Smith asked.

"Well, there would be a couple of options," Brown said. "I don't want to get into some of the details right now."

Ellis tried to quit in February after allegations of a sex scandal. But this week, a judge declared his resignation letter invalid. In that letter, Ellis wrote he was resigning his duties as mayor, not his office.

On Wednesday, we asked Ellis' attorney, John Cook, if the mayor plans to write a new resignation letter.

"We're weighing our options," Cook said. "There's a couple of decisions that need to be made, but I would advise him not to do that until he's had a chance to digest this ruling."

Ellis is apparently getting his salary and may even be due back pay, but unless or until Ellis reports for work, Shepherdsville is a city without its top leader.

"We never know when a situation comes up that really requires a major decision," Brown said. "You never know. We could have an emergency situation, and then what do we do?"

Late Thursday afternoon, WDRB's Lawerence Smith spoke again with Cook. He says Ellis will talk with his family over the weekend and make a decision about his future next week. But, Cook stresses, Ellis is the mayor, even if he is not City Hall.

Brian James, who had been serving as interim mayor, did not want to be interviewed.
